I am a resident at a development across the road from Mah Sing’s The Icon on
Jalan Tun Razak.
Since late July 2011, a number of my neighbours and I have had to put up with mild to extreme noise pollution from i-CLUB, the tenant of the penthouse level of The Icon. Live band vocals and bass are apparent until 2am most nights, but weekends are the worst, with deep and constant bass of dance music clearly audible until at least 3am.
After an initial complaint to the club, we received a letter dated 25 August 2011 from the club’s GM, stating, and I quote “We would like to apologize for the sound system is very noisy and disturbing the resident. We will try to control the sound and we manage this thing is not happen again. Once again sorry!!!” We then met with GM 6.30pm Monday 29 August 2011 and 5.30pm Friday 28 October 2011, at which he assured us the club would keep noise levels low enough not to bother us. He has not been true to his word, whether stated in his letter, or during either of our face to face meetings. In fact, it is almost as if the meetings never happened.
I have communicated via email with Mah Sing's [Senior Manager, Facilities Management]. He has been kind enough to hear us out, and says he met with GM on 28 September 2011. Sadly it appears that lying and deception is second nature to GM, as [Senior Manager, Facilities Management]’s meeting with him only resulted in a short term change.
It is now approaching four months that we have had to endure almost nightly vocals and deep bass. Our nightly SMS exchanges with the club rarely result in any lasting lowering of volume, and are overwhelmingly one-sided, as the club’s team chooses to ignore our pleas. On weekends, the situation is terrible.
Tan Sri, I do not know if there is anything Mah Sing Group can do as landlord. I am hoping there is. We have had tenants move out. We have newborns and their mothers being affected. What was once my peaceful home is now no longer.
[Senior Manager, Facilities Management] has not responded to any of my emails since end October 2011. I hope he is well, and not incapacitated in any way.

email detailing the ongoing situation we, residents of [development], are
currently undergoing with your current tenant, i-Club, at the Jalan Tun Razak
The Icon building.
I wanted to confirm Rabbitgut’s concerns and add that as a new tenant the
i-Club’s behavior and lack of professionalism has been shocking. Mostly because
they, the i-Club, did not move into a neighborhood that is known for its
nightclubs or happening nightlife. They moved into a neighborhood that houses
embassies, hospitals, luxury automobile dealerships and high end condominiums.
We as tenants and owners pay tens of thousands of dollars every month for the
privilege of living in this area and the i-Clubs behavior is tantamount to
harassment due to their complete lack of disregard to our right to quiet
enjoyment. Their behavior has led to extreme sleep deprivation for some of the
tenants, myself included, a mother of two young children. One of those
children, now only two and a half months old, I was in labor with while sending
sms messages to i-Club management pleading for them to lower the volume of
their incessant thumping club music. I’m sure you agree that that sounds
ridiculous - That a person should be subjected to such a situation in their own
home. The sad reality is, though, that it is happening and on a nightly basis.
The club claims they installed soundproofing after receiving our complaints but said “soundproofing” is either non-existent or completely useless.
In my opinion this tenant simply clashes with Mah Sing’s reputation and will only serve to hamper your growing reputation. Right now almost every resident, even if not directly affected, looks across the street at the i-Club, and therefore The Icon, with great disdain because they know the amount of pain they are causing many of us. Our pleas to club management have since fallen on deaf ears and I am now pleading with you to either evict the tenant or force them to follow through with double glazing of their windows (they said it was too expensive and therefore did not do it) and to install appropriate soundproofing that completely eliminates any noise from traveling to our homes.

I am impressed with The Icon on Tun Razak. Everything about it suggests quality and attention to detail. It is extremely unfortunate that that same attention does not appear to have extended to tenant selection. If you and your colleagues have an opportunity to visit the i-CLUB at penthouse level, I wonder if you will be as aghast as we were at the inappropriateness of the offer, and the immediate perception of low quality. A shame and a waste, as the views from the open terrace facing KLCC are truly stunning.
Despite the club not being to my personal taste, I accept that is has a right to exist and operate as much as any if it made every effort to ensure that the nature of its business and it’s hours of operation would not be a nuisance to any of its neighbours. Unfortunately in this, the i-CLUB has been completely and wilfully negligent, and continues to operate with impunity. Short of eviction, I feel the only acceptable solution is for the club to install the soundproofing that they have stated they would, the complete effectiveness of which must be to our total satisfaction.

I just received an abusive sms from GM. When I told him his actions were insane
and negligent because I could even hear the bass in my bathroom that faces the
opposite direction of the i-Club he responded by saying, “insane and
negligent!!! U sure of that!!! You want me to turn on the bass?” After 4 months
of repeated pleas with no appropriate action, the i-Clubs behavior is the
textbook definition of both insanity and negligence but now add to that that I
am being harassed directly by your tenant and that is beyond unacceptable. It’s
actually psychologically traumatizing and is now making me feel unsafe.

GM’s last sms about “turning the bass on”
has brought back to memory something that he said to Chris via sms about a
month ago.
He stated to the effect that he will have the “lamest club in KL” if
he has to turn off the bass. This is a clear indication that the bass can be
turned off, and in reality until your tenant installs adequate and substantial
soundproofing and window glazing, it should NOT be turned back on. Please make
that clear to him. It is not our fault that when leasing/buying the property
they did not perform their due diligence in understanding the area where they
would be opening their business, testing sound, etc. And we certainly are not
concerned about whether his club is lame or not. The amount of emotional and
physical aggravation this has been costing us due to sleep deprivation and
anxiety is extremely unfair as all they are doing as a business is providing a
venue for entertainment. The choice whether we want to be a part of said
entertainment has been taken out of our hands and we are forced to endure the
loud vocals and thumping bass into the wee hours of the morning.

Tonight is the usual big club night of
Saturday. In our experience to date with the i-CLUB, Saturday nights/Sunday
mornings are the worst we have to face. It will be interesting to see if your
